A K-1 visa or Fiancé visa is a non-immigrant visa issued to the fiancé(e) of a United States citizen. The K-1 visa allows the foreign-citizen fiancé(e) to travel to the United States and marry his or her U.S. citizen sponsor within 90 days of arrival.
A K-1 visa lets you come to the U.S. to get married, but it does not automatically grant you permanent resident status. Your fiancé(e) will need to file Form I-485, Application to Register Permanent Residence or Adjust Status, after you are married.
Key Requirements for the K-1 Visa Application
In order to qualify for a K-1 visa, both the U.S. citizen petitioner and the foreign fiancé(e) must fulfill certain requirements:
Legal Intent to Marry: The couple must prove that they have a bona fide intention to marry within 90 days of the foreign fiancé(e) entering the U.S.
Proof of Relationship: The couple will need to demonstrate proof of their relationship with photos, correspondence and/or meeting records that demonstrate the couple has met in person within the 2 years prior to the application (with a few exceptions).
U.S. Citizen Petitioner: The petitioner must be a U.S. citizen as permanent residents (Green Card holders) are not eligible to sponsor a K-1 visa.
Financial Support: The US citizen must proof that he/she has financial means to support his/her fiancé(e) and need to meet the minimum income requirement based on the US federal poverty guidelines.
Process and Timeline
The K-1 visa process generally includes the following steps:
Filing the Petition: The U.S. citizen fiancé(e) files Form I-129F (Petition for Alien Fiancé) with U.S. Citizenship and Immigration Services (USCIS).
Approval and Interview: Following USCIS’ approval of the petition, the foreign fiancé(e) will attend a visa interview at the U.S. embassy or consulate in his/her home country.
Visa Issuance: Assuming a favorable interview, a K-1 visa will then be issued to the foreign fiancé(e), allowing him/her to travel to the U.S.
Marriage: The couple must get married within 90 days of the foreign fiancé(e) entering the U.S.
Adjustment of Status: Once married, the foreign national can apply for a Green Card by filing Form I-485 (Application to Register Permanent Residence or Adjust Status) to become a permanent resident.
