Established by the Congress in 1990, the EB-5 program was created to help stimulate the U.S. economy through increased job creation and capital investment by foreign investors. EB-5 Visa: Key Requirements
To be eligible for an EB-5 visa, investors must meet the following criteria:
Investment Amount: Investors are required to invest a minimum amount of $1.05 million in a new U.S. commercial enterprise. If the investment is made in Targeted Employment Areas (TEAs)—either rural areas or areas experiencing unemployment exceeding 150% of the national average—the minimum investment threshold is reduced to $800,000.
Job Creation: The investment must create or preserve at least 10 full-time jobs for qualifying U.S. workers within two years of the immigrant investor’s admission to the United States as a Conditional Permanent Resident.
Active Participation: Investors are not required to manage their investment on a day-to-day basis, but they must demonstrate that they will be actively involved in policy formation (for example, as a corporate officer or board member) and/or in day-to-day management decisions (for example, through a limited partnership).
